ZenTile Studio Terms of Service

1.Eligibility

When you use the Services, you represent that: (a) you are at least 16 years of age (or of the age of consent in your jurisdiction), (b) the information you submit is truthful and accurate; (c) your use of the Services do not violate any applicable law or regulation; (d) you are of sufficient legal age or otherwise have the legal capacity to legally enter into these Terms.

2.Updates to these Terms of Service

We may modify these Terms of Service from time to time. We will notify you of material changes by posting the amended terms on the Services. You will be required to accept the new Terms the first time you log in after changes take effect. If you continue using the Service, you acknowledge that you will be bound by the modified Terms.

4.Account Registration

To access certain features, you may need to register an Account. You agree to: (a) provide accurate Registration Data; (b) maintain its accuracy; (c) keep your login credentials confidential. You are responsible for all activities under your Account. We reserve the right to reject user IDs that are offensive or violate third-party rights. WE EXPLICITLY DISCLAIM LIABILITY FOR ANY LOSSES ARISING FROM YOUR FAILURE TO SECURE YOUR ACCOUNT.

5.Use of the Services and Prohibited Activities

Our Services are for learning, gaming, and entertainment purposes only. They are NOT intended to diagnose or treat any medical condition. You agree not to:

• Use Services for illegal or unauthorized purposes.

6.Linking

We may terminate these Terms or your access at any time without notice if you breach these Terms. Upon termination, you must cease use of Services and destroy all copies of Content. Intellectual property, liability, and dispute provisions shall survive termination.

8.Premium Features

We may offer "Premium Features" via one-time "Lifetime Access" or recurring "Subscriptions."

• Subscriptions: Automatically bill your Payment Method (Apple App Store or Google Play Store) until cancelled. Cancel via App Store settings at least 24 hours before the next cycle.
• No Refunds: Payments are nonrefundable. We do not provide partial refunds for unused periods.
• Free Trial: If offered, your Subscription begins automatically after the trial ends unless cancelled.
• EEA/UK Residents: You have a 14-day right of withdrawal. To exercise this, contact support@zentilestudio.com or mail us at our Singapore address.

9.Intellectual Property Rights

All content (logos, text, graphics, code, images) is owned by LIGHTCHASER TECHNOLOGY PTE. LTD. or its licensors. We grant you a limited, non-commercial license to use the Services. You may not reproduce or distribute Content without written permission.

10.Content Submitted by You

You are responsible for your "User Content." By submitting it, you grant ZenTile Studio a royalty-free, perpetual, worldwide, irrevocable license to use, modify, and distribute such content for any purpose. DO NOT SEND US CONFIDENTIAL IDEAS.

11.Third-Party App Stores

Your use is also governed by the terms of the Apple App Store or Google Play Store. These Terms are between you and us, not the App Store provider.

12.Third Party Sites

We are not responsible for the content or practices of third-party websites linked within our Services. Use them at your own risk.

13.Disclaimer of Medical Advice

IN THE EVENT OF A MEDICAL EMERGENCY, CONTACT EMERGENCY SERVICES IMMEDIATELY. Our content is for educational purposes only and is NOT a substitute for professional medical advice, diagnosis, or treatment.

15.Legal Disputes, Arbitration Agreement, and Class Action Waiver

PLEASE READ CAREFULLY.

• Initial Dispute Resolution: You agree to first attempt to resolve disputes informally by contacting support@zentilestudio.com.
• Binding Arbitration: If unresolved within 60 days, disputes shall be determined by binding arbitration in Hong Kong before one arbitrator, conducted in accordance with JAMS expedited procedures.
• No Class Actions: You may only bring claims in your individual capacity.
• Mass Arbitration: In the event of 25+ similar claims, NAM (National Arbitration & Mediation) rules shall apply.
• Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law rules.

16.Warranty Disclaimer; Limitation on Liability

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS OR IMPLIED). OUR TOTAL LIABILITY SHALL NOT EXCEED THE ACTUAL AMOUNT RECEIVED BY US FROM YOU.

17.Indemnity

You agree to indemnify and hold ZenTile Studio and its officers harmless from any claims, damages, or costs (including attorneys' fees) arising from your breach of these Terms or your use of the Services.

18.Notice to New Jersey Users

Provisions that are unenforceable under New Jersey law do not apply to New Jersey residents, but the remainder of the Terms stay in effect.

19.Notice to California Users

California residents may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Sacramento, CA 95834.

20.Digital Millennium Copyright Act (DMCA) Policy

If you believe your copyright is infringed, send a notice to support@zentilestudio.com with the subject "DMCA Notice" including: (1) identification of the work; (2) the infringing link; (3) your contact info; (4) a statement of good faith.

21.General Terms

• Assignment: We may freely assign these Terms. You may not.
• Severability: If any part of these Terms is void, the rest remains valid.
• Mobile Services: Standard carrier data rates apply.
